Rounderly Terms of Service
Effective date: October 9, 2026
Version: 3.0
These Terms of Service ("Terms") are a binding agreement between you and the operator of Rounderly ("Rounderly", "we", "us", "our"). They govern your use of the Rounderly website at rounderly.vercel.app, any successor address, and every feature offered through it (together, the "Service").
By ticking the acceptance box, and by subscribing or using the Service in any way, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
To contact us, sign in, open Your account from your name at the top of any page, and choose Contact us. These Terms call that "the contact form".
Please read Sections 3 (Your account, subscription and payment), 4 (Not medical advice), 5 (No real patient information), 14 (Disclaimers), 15 (Limitation of liability) and 18 (Disputes) with particular care.
1. What the Service is
Rounderly is a practice tool for medical students and other healthcare learners. It lets you:
- choose or describe a type of clinical case;
- speak with a simulated patient, whose words are written by an artificial intelligence model and spoken in a synthetic voice;
- take notes during the encounter;
- review and correct a transcript of what was said;
- present the case aloud to a simulated attending, or skip that step; and
- receive scores against a rubric, written feedback, marks on your transcript and a model presentation, all generated by an artificial intelligence model.
Every patient, case, name, history, vital sign and diagnosis in the Service is fictional and machine-generated. Any resemblance to a real person is coincidental.
2. Who may use the Service
2.1 Age. You must be at least 18 years old. The Service is not directed to anyone under 18, and you may not use it if you are under 18.
2.2 Capacity. You confirm that you can form a binding contract and that no law where you live prohibits you from using the Service.
2.3 Beta. The Service is currently in beta. We may limit who can use it, including by making it invitation-only and requiring an access code that we issue. We may decline to issue a code, and we may withdraw one, at any time and for any reason.
2.4 Use on behalf of an organisation. If you use the Service for a school, program or other organisation, you confirm that you have authority to accept these Terms for it, and "you" includes that organisation.
3. Your account, subscription and payment
Your account
3.1 Signing in. You sign in to the Service with a Google account. We do not issue or hold a password. Signing in creates an account for you with us, identified by your Google account.
3.2 One account, for you alone. Your account is for you alone. Do not share it, sell it or let anyone else use it. Do not create or use more than one account, including to obtain more free sessions.
3.3 Your responsibility. You are responsible for keeping your Google account secure, and for everything done through your account with us until you tell us it has been compromised. Tell us promptly through the contact form if you believe someone else has used it.
3.4 Access codes. If the Service is invitation-only when you use it, your access code is also for you alone. We may change, rotate or revoke access codes at any time without notice.
Free sessions
3.5 Each account may start a limited number of practice sessions free of charge. The number is shown in the Service. We may change it, or withdraw free sessions, at any time. A free session is used when the case for that session has been prepared, whether or not you finish the session.
Subscription
3.6 What it is. A subscription lets you start practice sessions for as long as it runs, within the fair-use limit in Section 3.9. It is a licence to use the Service to that extent, billed monthly. Passes and packs of sessions sold before October 9, 2026 remain as described when they were bought.
3.7 It renews automatically until you cancel. When you subscribe, you authorise us, through our payment provider, to charge your payment method the monthly price shown at checkout at the start of each monthly billing period, until you cancel. Each billing period is one month, starting on the day you subscribed and renewing on the same day of each following month (or the last day of a shorter month).
3.8 Cancelling. You can cancel at any time, and there is no fee for cancelling. Sign in, open Your account from your name at the top of any page, choose Manage subscription, and cancel there. Cancelling takes effect at the end of the billing period you have already paid for: you keep access until then, and you are not charged again. You can also ask us to cancel through the contact form, and we will do it within two business days, with the same effect.
3.9 Fair use. A subscription is for one person's own practice. It does not count sessions, but we treat up to 25 sessions started in one billing period as fair use. If you reach that number we may pause the subscription, and we will restore it, extend it or refund the period as we think fair once we have heard from you. We may also pause an account that is used far beyond what one person practising could need, and Section 9 applies.
3.10 Failed payments. If a renewal payment fails, our payment provider will retry it and may email you. Until the payment succeeds you cannot start sessions. If it cannot be collected, the subscription ends.
3.11 Not transferable. A subscription belongs to the account that holds it. It cannot be transferred, shared, resold or exchanged for money.
Price and payment
3.12 Price. The monthly price is shown before you subscribe, and each payment is confirmed to you by email. We may change the price. If we do, we will tell you by email, to the address of the Google account you sign in with, at least 30 days before the new price applies to your subscription, and you can cancel before it applies. A change does not affect a pass you have already bought.
3.13 Payment. Payment is taken by our payment provider, Stripe, on its own page. You agree to give accurate payment details and confirm that you are entitled to use the payment method. We do not receive or store your card number. Stripe's own terms and privacy policy apply to the payment.
3.14 Taxes. Prices do not include taxes unless stated. Where tax applies, it is shown before you pay.
Refunds
3.15 Refunds. If a session fails because of a fault on our side, tell us and we will restore it. If you are not satisfied after subscribing, ask for a refund of your first payment through the contact form within 14 days of it. If you have started no more than one session since subscribing, we will refund it in full and end the subscription. Renewal payments are not refundable, except where the law requires or these Terms say otherwise: cancel before the renewal instead, and you will not be charged again. A refund ends the subscription it was for.
3.16 Disputed payments. Please contact us before disputing a charge with your bank or card issuer, so we can put it right. We may suspend an account while a payment is in dispute.
3.17 Your legal rights. Nothing in this Section removes any right to cancel or to a refund that the law of your country gives you and that cannot be waived. If the law gives you a right to cancel within a set period, you agree that the subscription may be used at once, and you acknowledge that starting a session during that period may reduce or end that right where the law allows.
4. Not medical advice, and not a clinical tool
4.1 Education only. The Service exists for education and practice. It is not a medical device. It does not provide medical advice, diagnosis or treatment, and nothing in it should be used to make a decision about the care of any real person, including yourself.
4.2 Artificial intelligence makes mistakes. Cases, patient answers, scores, feedback, corrections and model presentations are generated by artificial intelligence. They can be incomplete, outdated, clinically wrong, internally inconsistent or simply invented. Do not treat anything in the Service as an authoritative clinical reference. Check clinical facts against your course materials, current guidelines and your instructors.
4.3 Transcription makes mistakes. Speech is converted to text by an automated system that can mishear, drop or invent words. The Service gives you a chance to correct the transcript before grading. You are responsible for checking it. Grading is based on the transcript as submitted.
4.4 No doctor-patient relationship. Using the Service creates no doctor-patient, clinician-patient or other professional relationship between you and us, or between you and anyone else.
4.5 Emergencies. If you or someone else may be having a medical emergency, call your local emergency number. Do not use the Service.
5. No real patient information, and no sensitive personal information
5.1 Never enter real patient information. You must not speak, type or otherwise submit information about any real patient or any other identifiable real person. This includes names, dates of birth, record numbers, contact details, images, and any account of a real clinical encounter detailed enough to identify the person.
5.2 Not a HIPAA service. We are not a covered entity or a business associate under the U.S. Health Insurance Portability and Accountability Act ("HIPAA"). We do not sign business associate agreements. The Service is not designed to hold protected health information, and you must not put any into it.
5.3 Your own sensitive information. Do not speak or type your own health information, government identifiers, financial details, passwords or other sensitive personal information. The Service does not need them.
5.4 Custom cases. If you describe your own case, describe it in general clinical terms only (for example, "chest pain in a middle-aged smoker"). Do not base it on an identifiable real person.
5.5 Your responsibility. You are solely responsible for anything you submit in breach of this Section, and Section 16 (Indemnity) applies to it.
6. Scores and feedback
6.1 Practice scores only. Scores and feedback are an automated estimate for your own practice. They are not an academic grade, a credential, a certification or an assessment of competence or fitness to practise.
6.2 No prediction. Scores do not predict, and we make no promise about, your results in any examination, course, clerkship, residency application or licensing process.
6.3 Variation. The same performance may receive different scores or feedback on different attempts. Rubrics, models and scoring may change without notice.
6.4 Not for decisions about others. You must not use scores or feedback from the Service to make academic, employment, admission, disciplinary or licensing decisions about any person.
6.5 What is not assessed. The Service assesses only what can be heard in a spoken interview and presentation. It does not assess physical examination, procedural skill, non-verbal communication or anything else it states as not assessed.
7. No affiliation or endorsement
7.1 Rounderly is independent. It is not affiliated with, sponsored by, approved by or endorsed by any medical school, university, hospital, licensing body or examination organisation, including the National Board of Medical Examiners, the Federation of State Medical Boards, the United States Medical Licensing Examination program, the Association of American Medical Colleges and the Educational Commission for Foreign Medical Graduates.
7.2 Names of examinations, organisations and frameworks belong to their owners and are used only to describe what the Service helps you practise.
7.3 The rubric is our own adaptation informed by publicly available clinical skills frameworks and by feedback from students. It is not the official rubric of any school or examination.
8. Microphone, recordings and synthetic voice
8.1 Microphone. The Service needs your microphone. Your browser will ask for permission. You can withdraw permission in your browser settings at any time, after which the spoken parts of the Service will not work.
8.2 Consent to recording and processing. You consent to the Service recording your voice while you hold a speaking turn, sending that recording to our server and to our transcription provider, and converting it to text. Recording starts and stops when you click the button, not on silence.
8.3 Other people nearby. Your microphone can pick up other voices. Use the Service somewhere private. You are responsible for making sure no one else is recorded without their knowledge and consent, and for complying with recording laws where you are.
8.4 Synthetic voices. The patient's voice is computer-generated. It is not a real patient and does not represent any real person.
8.5 No voice identification. We do not use your recordings to identify you, and we do not create a voiceprint or any other biometric template from them. The Privacy Policy explains how recordings are handled.
9. Acceptable use
You agree that you will not, and will not help anyone else to:
- use the Service for any purpose other than personal education and practice;
- use the Service to obtain or give clinical advice about a real person;
- submit real patient information or other prohibited information described in Section 5;
- share, sell or transfer your account, a subscription, a pass or an access code, use one that is not yours, or create more than one account;
- bypass, probe or test the access controls, rate limits or other security measures of the Service;
- call the Service's interfaces directly, or use scripts, bots, scrapers or other automated means, except through the ordinary use of the website in a browser;
- use the Service as a general-purpose route to the underlying artificial intelligence, voice or transcription providers, or for any task unrelated to a practice encounter;
- attempt to extract, reveal or reconstruct the prompts, instructions, rubric logic or hidden case data behind the Service, other than what the Service shows you in the ordinary course;
- copy, reverse engineer, decompile or create derivative works of the Service, except where the law gives you a right to do so that cannot be waived;
- resell, sublicense, rent or commercially exploit the Service or its output;
- use the Service or its output to build, train or improve a competing product or a machine learning model;
- submit content that is unlawful, harassing, hateful, sexually explicit, defamatory, or that infringes anyone's rights;
- attempt to make the simulated patient or grader produce harmful, unlawful or abusive content;
- upload malicious code or interfere with the operation of the Service or the systems of our providers;
- place an unreasonable load on the Service or run up costs in bad faith;
- misrepresent output from the Service as the work or opinion of a human clinician, instructor or examiner;
- present practice scores as an official result; or
- use the Service in breach of any law, or of any honour code, academic integrity policy or institutional rule that applies to you.
We may investigate suspected breaches and may suspend or end access without notice.
10. Third-party providers
10.1 The Service depends on third parties, including providers of sign-in, payment, artificial intelligence models, speech transcription and synthetic voice, hosting, and storage. We may add, remove or replace providers.
10.2 Your use of the Service must also be consistent with those providers' usage policies. Content that breaches their policies may be refused.
10.3 We do not control those providers and are not responsible for their acts, omissions, outages or changes.
11. Your content
11.1 What it is. "Your Content" means what you speak or type into the Service: your side of the encounter, your presentation, your notes, any custom case description and any review you send.
11.2 Ownership. You keep whatever rights you have in Your Content.
11.3 Licence to operate the Service. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, process and display Your Content as needed to operate the Service for you, including sending it to the providers named in Section 10.
11.4 Reviews and suggestions. If you send us a review, idea or suggestion, you give us a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose, including improving the Service and quoting it in our materials. We will not attach your name to a quoted review without your permission. You have no right to payment for it.
11.5 Your promises. You confirm that you have the right to submit Your Content and that it does not breach these Terms or anyone's rights.
12. Our intellectual property
12.1 The Service, including its software, design, text, rubric, prompts, generated cases and the Rounderly name and mark, belongs to us or our licensors and is protected by law.
12.2 We give you a personal, limited, revocable, non-exclusive, non-transferable licence to use the Service and its output for your own education and practice, subject to these Terms.
12.3 You may keep copies of your own feedback for personal study. You may not publish, sell or distribute cases, rubric content or model presentations from the Service.
12.4 All rights not expressly given to you are reserved.
13. Beta service, availability and changes
13.1 Beta. The Service is a beta. It may contain errors, may be slow, and may lose a session in progress. Features may change or disappear without notice.
13.2 No saved history. The Service keeps an account for you, but it does not keep your sessions. A session exists in your browser tab and is lost when you close or reload the tab, when your device sleeps, or if something fails. We cannot recover a lost session, transcript or feedback report. Save anything you want to keep.
13.3 Browser and device support. The Service is built for current desktop browsers with a working microphone. It may not work properly on other browsers, on phones or behind some networks.
13.4 No uptime commitment. We do not promise that the Service will be available, uninterrupted, timely or free of errors. Time during which the Service is unavailable is not added to a subscription or a pass, unless we choose to add it.
13.5 Changes and withdrawal. We may change, limit, suspend or close the Service, in whole or in part, at any time, with or without notice. If we close the Service while your subscription or pass is running, we will refund the unused part of the billing period or pass you have paid for, in proportion to what you paid, and you will not be charged again.
13.6 Fees. Free sessions, the subscription, prices and refunds are covered in Section 3.
14. Disclaimers
14.1 THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.
14.2 WITHOUT LIMITING THAT, WE DO NOT WARRANT THAT ANY CASE, PATIENT ANSWER, TRANSCRIPT, SCORE, FEEDBACK OR MODEL PRESENTATION IS CLINICALLY ACCURATE, COMPLETE, CURRENT OR SUITABLE FOR ANY PURPOSE, OR THAT USING THE SERVICE WILL IMPROVE YOUR PERFORMANCE IN ANY EXAMINATION OR CLINICAL SETTING.
14.3 You use the Service at your own risk. Some places do not allow certain warranties to be excluded, so parts of this Section may not apply to you.
15. Limitation of liability
15.1 TO THE FULLEST EXTENT THE LAW ALLOWS, WE AND OUR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, ACADEMIC STANDING OR EXAMINATION RESULTS, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, WHATEVER THE LEGAL THEORY AND EVEN IF WE WERE TOLD THE DAMAGE WAS POSSIBLE.
15.2 TO THE FULLEST EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, AND (B) FIFTY U.S. DOLLARS (US $50).
15.3 WE ARE NOT LIABLE FOR ANY HARM ARISING FROM RELIANCE ON OUTPUT OF THE SERVICE IN THE CARE OF A REAL PERSON, OR FROM INFORMATION YOU SUBMITTED IN BREACH OF SECTION 5.
15.4 These limits apply even if a remedy fails of its essential purpose. They reflect a fair allocation of risk for a low-cost beta service. Nothing in these Terms limits liability that cannot be limited by law. Some places do not allow some of these limits, so parts of this Section may not apply to you.
16. Indemnity
To the fullest extent the law allows, you will defend, indemnify and hold harmless Rounderly and its owners, officers, employees, contractors and providers against any claim, loss, liability, damages, cost and expense (including reasonable legal fees) arising from:
- Your Content, including any real patient information or other prohibited information you submitted;
- your breach of these Terms;
- your breach of any law or of anyone's rights, including privacy and recording laws; or
- your use of output from the Service in any clinical, academic or professional decision.
We may take over the defence of any such claim at our own cost, and you will cooperate with us.
17. Suspension and termination
17.1 You may stop using the Service at any time.
17.2 We may suspend or end your access at any time, with or without cause or notice, including by placing your account on hold or closing it.
17.3 If we end your access because you breached these Terms, you are not entitled to a refund. If we end your access for any other reason while your subscription or pass is running, we will refund the unused part, worked out as in Section 13.5, and you will not be charged again.
17.4 You may ask us to close your account at any time through the contact form. Closing your account ends your subscription and any pass that is still running; if you ask us to close it part-way through a billing period you have paid for, we will refund the unused part as in Section 13.5.
17.5 Sections 3.11 to 3.17, 4 to 7, 9, 11.4, 12 and 14 to 20 continue to apply after your access ends.
18. Governing law and disputes
18.1 Talk to us first. Before starting any formal proceeding, you agree to send us a written description of the dispute through the contact form and to give us 60 days to try to resolve it.
18.2 Governing law. These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules.
18.3 Courts. Any dispute that is not resolved informally will be brought only in the state or federal courts located in Collin County, Texas. You and we consent to the jurisdiction of those courts.
18.4 No class actions. To the fullest extent the law allows, you and we will each bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective or representative proceeding.
18.5 Jury trial waiver. To the fullest extent the law allows, you and we each waive the right to a trial by jury.
18.6 Time limit. To the fullest extent the law allows, any claim must be brought within one year after it arose, or it is permanently barred.
18.7 Consumer rights. If you are a consumer living outside the United States, nothing in this Section removes protections that the mandatory law of your country gives you, including any right to bring proceedings in your home courts.
19. Changes to these Terms
19.1 We may change these Terms. When we do, we will update the version and effective date at the top, and where the change is material we will ask you to accept the new version before you next use the Service.
19.2 If you do not agree to a change, stop using the Service.
20. General
20.1 Whole agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service, and replace anything said earlier.
20.2 Severability. If a court finds part of these Terms unenforceable, that part will be enforced as far as the law allows and the rest will stay in force.
20.3 No waiver. If we do not enforce a term, we have not waived it.
20.4 Assignment. You may not transfer your rights under these Terms. We may transfer ours, including in a merger, sale or reorganisation.
20.5 No third-party rights. These Terms give no rights to anyone other than you and us, except that the persons named in Sections 15 and 16 may rely on those Sections.
20.6 Events outside our control. We are not liable for a failure or delay caused by something outside our reasonable control, including failures of our providers, internet outages, and natural events.
20.7 Export and sanctions. You confirm that you are not in a country under U.S. embargo and are not on any U.S. government list of restricted parties.
20.8 Electronic agreement. You agree that accepting these Terms electronically has the same effect as signing them, and that we may give you notices electronically, including by email to the address on your account and by posting them in the Service.
20.9 Headings. Headings are for convenience and do not affect meaning. "Including" means "including without limitation".
20.10 Language. These Terms are written in English. If they are translated, the English version controls.
